Eugene joined Belperio Clark in September 2009.

Eugene Reinboth practises in the areas of business advice, intellectual property and technology, commercial transactions, dispute resolution and franchising. He also regularly advises on trade practices, wine law and international business issues.

In intellectual property and technology matters, Eugene’s expertise includes conducting intellectual property audits to assess assets and opportunities, advising on structuring and commercialisation options, and resolving disputes. He advises on the protection of intellectual property assets, including registering trade marks and advising on patents and copyright. He also assists clients with brand selection and protection, including domain name registration and domain name dispute resolution. Eugene’s experience includes advising on intellectual property issues relating to information technology, biotechnology and defence technology.

In his broader practice, Eugene acts for companies, small businesses, partnerships, franchisors and franchisees, not for profit organisations, in a range of commercial transactions, including the sales and acquisitions of businesses and assets.

He also regularly advises on international transactions and business arrangements, including negotiating and drafting sale, manufacturing and service agreements, as well as advising on outsourcing options. His experience in this area includes advising franchisors on establishing franchisee operations in international locations.

Eugene opened up Reinboths – Business and IP Lawyers on leaving Donaldson Walsh’s Commercial and IP Section in early 2009.

Before joining Donaldson Walsh in 2000, Eugene was the Managing Partner of Stanley & Partners, where he specialised in civil litigation, administrative, employment, industrial and workers compensation law.

Relevant Experience

Eugene’s expertise in intellectual property law includes:

  • advising on technology and intellectual property
  • conducting audits to assess intellectual property assets and opportunities
  • advising on structuring, including joint ventures, alliances, trusts and companies
  • advising on commercialisation options, including licence agreements and sales
  • advising on the protection of intellectual property assets, including registering trade marks and advising on patents, copyright, design issues, trade secrets and confidential information, and
  • resolving disputes relating to patent, trade mark, copyright and registered design infringements.
  • His recent intellectual property experience includes:
  • acting for a software developer who creates and coordinates the hosting of websites in the acquisition of its contract by an UK company
  • advising the Centre for Appropriate Technology on privacy, copyright and contractual issues relating to its website
  • mentoring small businesses on intellectual property issues through a state-sponsored scheme
  • advising the organisers of a cultural festival on intellectual property issues arising from film productions
  • advising the inventor of a mining industry tool on commercialisation options
  • advising an accountant on the commercialisation of its online financial tool, including negotiating licensing with a peak body
  • advising and assisting the IP commercialisation units of Adelaide and Flinders Universities
  • acting for an importer in defending patent infringement allegations made by a multinational corporation in the Federal Court, and
  • acting for the manufacturer of building products in the enforcement of its patent rights and in subsequent licence deals.

His broader local and international corporate and commercial experience includes:

  • advising on commercial transactions, including the sales and acquisitions of businesses and assets
  • advising on franchising issues, including establishing franchises, selling franchised businesses and resolving related disputes
  • negotiating and drafting manufacturing and service agreements in Australia and for the overseas market
  • advising on trade practices issues
  • advising on international outsourcing options, and
  • resolving shareholder and other commercial disputes.

Highlights of his recent experience include:

  • advising on the establishment of a manufacturing plant in India for Australian and US partners
  • advising a developer of management software programs on outsourcing options in India and Sri Lanka
  • advising on a $35-$40m contract with Indian Railway
  • acting in a shareholder dispute over a corporate governance issue, and
  • acting for a plastics manufacturer in a dispute relating to its acquisition of an insolvent company and in subsequent contractual disputes with various suppliers.

Eugene also has a special interest in wine law and has advised industry participants on issues including corporate governance, intellectual property associated with wine labels, geographical indications, grape supply agreements, vineyard leases and distribution agreements. His track record in this area includes:

  • advising Hardy Wine Company on intellectual property issues, including brand protection
  • advising on a new cellar door licence for Kilikanoon Wines
  • advising on trade mark opposition proceedings for wine brands
  • advising wineries as to overseas markets and
  • advising stakeholders in a vineyard and winery in the Tumbarumba region

Other Information

In addition to his law degree, Eugene has a Master of Business Administration and a Master of Intellectual Property Law.
Eugene also speaks and writes Hindi and has a good understanding of India’s culture and business environment. He is a regular presenter at seminars and workshops and has been a member of an international team of instructors delivering an intellectual asset management course in India. He also presented at a recent seminar in Mumbai on ‘Global Best Practices in Intellectual Asset Management’.

He is a board member of the Licensing Executives Society of Australia and New Zealand, a member of the Alternative Dispute Resolution Committee and LawAsia Committees of the Law Society of South Australia, and a fellow of the Taxation Institute of Australia. Eugene is also a member of the Intellectual Property Society of Australia and New Zealand, member of the Management Committee (SA) of the Australia India Business Council and the Australian Institute of Company Directors.
